Florida DUI Penalties
If you were accused of DUI in Palm Bay, Indialantic, or Satellite Beach, know that the prosecution will do everything in its power to subject you to the following DUI penalties:
- First conviction: $500 to $1,000 fines and up to 6 months in prison
- Second conviction: $1,000 to $2,000 fines and up to 9 months in prison
- Third conviction (committed within 10 years of prior DUI conviction): Third-degree felony charge punishable by up to $5,000 fines and 5 to 10 years in prison
- Third conviction (committed more than 10 years of prior DUI conviction): $2,000 to $5,000 fines and up to 12 months in prison
- Fourth or subsequent conviction: Third-degree felony charge punishable by $2,000 to $5,000 fines and5 to 10 years in prison
If your BAC was .15 or higher or a person under 18 years old was in the vehicle at the time of your alleged DUI, your penalties may be the following:
- First conviction: $1,000 to $2,000 fines and up to 9 months in prison
- Second conviction: $2,000 to $4,000 fines and up to 12 months in prison
