Cocoa Beach DUI Charges & Defenses

Depending on the circumstances of your case, you could be charged with a simple, first offense DUI. You could also be charged with aggravated DUI if you were involved in an accident where someone was hurt, you were transporting a minor, or one of many other factors are present. Naturally, the penalties for aggravated DUI will be much greater than those of a simple DUI offense. It is also important to know that you have the right to refuse a chemical test, but your license will be automatically and immediately suspended.

There are many different factors that will determine the severity of your charges, and by the same token, there are many different elements that can play a part in the defense of your case. Even though the legal BAC limit is 0.08% in Florida, you could still be charged with DUI if you blow a reading lower than the intoxication limit.

A few factors could also cause a BAC reading to turn out false:

  • If there is any alcohol in your mouth (even residue) at the time of the test, it will read higher
  • If you hold your breath for just a few seconds before blowing, the readout will be altered
  • If the machine was not recently calibrated, or is not functioning perfectly, your readout could be wrong
