Depending on the circumstances of your case, you could be charged with a simple, first offense DUI. A few factors could also cause a BAC reading to turn out false:

- If you hold your breath for just a few seconds before blowing, the readout will be altered
- If the machine was not recently calibrated, or is not functioning perfectly, your readout could be wrong
