Third Time DUI in Florida

If you are convicted of a third DUI in the state of Florida, you must pay a fine of not less than $1,000 or more than $2,500. You will also be incarcerated for a time period of no more than twelve (12) months. A third or subsequent DUI conviction in the state of Florida is considered a Felony charge of the Third Degree.

If you are convicted of a third DUI within a ten year period in the state of Florida, your license will be revoked for ten years. You will serve two full years of this revocation period before being eligible to apply for a hardship license. You will have to complete DUI School and treatment, if referred, and have a favorable recommendation from the Special Supervision Services Program to be eligible for a hardship license.

If your hardship license is approved, you will have to present this approval to the driver license office. You will also have to remain in the Special Supervision Services Program for the duration of the revocation period to retain your hardship license.

If you wait until after the full term of your revocation to reinstate your driving privilege, you will have to prove you completed DUI School, and treatment, if referred. Failure to complete the course within 90 days after reinstatement will result in cancellation of your driver license until the course is completed, and could result in cancellation of your driver license.

At the time your license is reinstated, whether for a hardship license or a full license, you will have to take the required examination, pay $115 administrative fee and $60 reinstatement fee as well as any required license fee. DUI convictions on or prior to October 1, 2007, mean you must provide proof of bodily injury liability insurance in the amount of $10,000 per person and $20,000 per occurrence and $10,000 property damage liability on the arrest date. Alternatively you may provide proof of bodily injury liability coverage and pay a $15 reinstatement fee. After October 1, 2007, you must provide proof of bodily injury liability insurance in the amount of $100,000 per person, $300,000 per occurrence and $50,000 property damage liability on the arrest date or proof of liability coverage and a reinstatement fee of $150 up to $500.
