Second Time DUI in Florida
If individuals are convicted of DUI in the state of Florida for a second time, individuals will have to pay a fine of not less than $500 or more than $1,000. Individuals will also be imprisoned for 9 months or less. Also, if individuals are convicted of a second DUI within 5 years, drivers' licenses will be revoked for somewhere between 180 days and a year, and cannot be reinstated early for hardship. This full period must be served in every case, with no exceptions, before an individual’s license will be reinstated.
A second conviction within a 5 year period will result in a 5-year revocation of an individual’s driving privilege. After individuals serve the first year, individuals can apply for a hardship license at the Administrative Reviews Office. DUI School, and treatment, if referred, must be completed and individuals also need to have a favorable recommendation from the Special Supervision Services Program to be eligible for a hardship license. Individuals will have to remain in the Special Supervision Services Program for the duration of the revocation period to retain individual's a hardship license.

If individuals wish to reinstate their license after the end of a revocation period, individuals must prove that individuals have enrolled or completed DUI School and also any referred treatment. Failure to complete the course within 90 days after reinstatement will result in cancellation of individual driver’s license until the course is completed. Failure to complete treatment may also result in cancellation of individual’s driver’s license.
When an individual’s license is reinstated, whether a hardship license or full license, individuals must take the examination and pay the $115 administrative fee and $60 reinstatement fee and any other license fee required. For a DUI conviction on or prior to October 1, 2007, individuals must provide proof of bodily injury liability insurance in the amount of $10,000 per person and $20,000 per occurrence and $10,000 property damage liability on the arrest date or proof of bodily injury liability coverage and a $15 reinstatement fee will be required. Any DUI conviction after October 1, 2007, must provide proof of bodily injury liability insurance in the amount of $100,000 per person, $300,000 per occurrence and $50,000 property damage liability on the arrest date or proof of liability coverage and a reinstatement fee of $150 up to $500, for subsequent violations will be required.
