Criminal Defense Terms
Administrative probation - a form of noncontact supervision that may be imposed if an offender presents a low risk of harm to the community. The offender may, upon satisfactory completion of half of the term of probation, be granted non-reporting probation for the duration of the term imposed.
Drug offender probation - supervision emphasizing treatment of drug offenders in accordance with individualized plans.
Probation - community supervision that requires specified contacts with parole and probation officers.
Community control - a form of supervised custody in the community, which includes surveillance on weekends and holidays. Community control is an individualized program in which the freedom of an offender is restricted within the community, home, or non-institutional residential placement and specific sanctions are imposed and enforced.
Community residential drug punishment center - a residential drug punishment center designated by the Department of Corrections.
Criminal quarantine community control - supervision involving 24-hour-a-day electronic monitoring, and confinement to a designated residence during designated hours.
Qualified practitioner - a licensed psychiatrist or psychologist, social worker, mental health counselor, or marriage and family therapist who, as determined by rule of the respective boards, has the coursework, training, qualifications, and experience to evaluate and treat sex offenders.
Risk assessment - An assessment completed by a qualified practitioner to evaluate the level of risk if a sex offender comes into contact with a child.
Safety plan - a written document prepared by the qualified practitioner, in collaboration with the sex offender, the child's parent or legal guardian, and, when appropriate, the child. This document establishes clear roles and responsibilities for each individual involved if there is any contact between the child and the sex offender.
Sex offender probation - supervision, with or without electronic monitoring, emphasizing treatment and supervision of a sex offender in accordance with an individualized treatment plan.
