When Accidents Occur, Bars Not Held Liable

Under Florida’s dram shop law, bars that serve alcoholic drinks to patrons of legal drinking age are not liable for any injury or damage that might occur if an intoxicated patron were to cause an accident. Bars are not liable in any case that involves drunk driving by one of their patrons as stated in Florida’s dram shop law. The question of liability arose when two friends went bar hopping around Pensacola one night. One of the friends drove his Chevrolet SUV while intoxicated the wrong way on the Pensacola Bay Bridge, colliding head on with another pickup truck. The driver of the pickup, Antonio Fulfer, was killed in the accident.

The dram shop law states that any bar that serves alcoholic beverages to patrons of legal drinking age cannot be held liable for damage, injury, or death resulting from the driver’s intoxication. This law will be battled to be changed by Florida’s chapter of MADD, who feel that bars should be held somewhat liable for injury, damage, and death resulting from a driver’s intoxication. Other states do hold bars and restaurants that serve alcohol liable as well as individual residences.
